    More seriously, it is people like him, Rush, Bill-O and a host of others that make it difficult for myself and any others who may have some legit concerns about Sotomayor to have any kind of conversation about her appointment.

    At this time, I think her nomination was primarily a brilliant political move by BHO, but we, the people, might have to endure the lifetime appointment of someone who may not be impartial enough to sit on the SCOTUS.

    SCOTUS has nothing to do with anything but politics. It’s all a game. There is nothing impartial about them. Just witness how all the important votes go and you can see that. Impartiality doesn’t exist on SCOTUS. I don’t know if it ever did, but it sure doesn’t now.

    It’s all a game to these people. The only thing that matters is partiality on your side. We have been pretending to be a Democracy with a Constitution for decades. What the founding fathers founded disappeared long ago.

    Granted, I would not fare well in a room full of ultra-conservative white guys, but I would fare just as badly in a room full of people who espouse what the right is trying to get us to believe about Sotomayor.

    The SCOTUS is soon going to have to decide issues like gay marriage and other social issues that will effect all of us. Lifetime appointments to what amounts to a room full of extremists playing “gotcha” with each other isn’t exactly the answer.

    If it were up to me, I would take away the lifetime appointments. That would help to get appointments that had something to do with our rights rather than political prowess

  10. Anthony, I think i initially, the lifetime appointments were there so that they didn’t have to listen to politicians to keep their jobs. Somewhere along the line, people began to test social issues. I think that started when we inferior people, such as women, started saying, Hey Wait A Minute! I want to vote! Damn us. Next came Roe v Wade. Then gay and lesbian issues, and suddenly the appointments became tests of personal feelings. Golly, we were supposed to all shut up or something. Then everything would have been jussssssst fine.

The left has their fair share of far left cliff hangers that are not representative of the Democratic Party any more than Liddy and his ilk are of the Republican party. The extremes have a solid hold on both parties squeezing out the voices of the centrist.

    Uppity you are so correct about the Supreme Court as much as everything changes everything stays the same. We have a court of extremists, the whole impartial, justice is blind thing flew out the window long ago, if it ever really existed. I don’t think this type of idealogical court is what the founding fathers had in mind. I think they wanted the best and the brightest legal minds on the bench. Proven, scholarly, objective justices and I think the lifetime appointments were to keep those justices free from the political winds and to provide the ultimate check and balance to our system. But hell we weren’t there, we don’t really know it may have always been this way….to the victor go the spoils!

I used to see the occasional justice wandering around Cleveland Park in DC–hard to think of them as extremists, or even as the best and brightest…They got the job, they kept the job, they read a lot, I dont know. This sounds dumb on my part. Everyone has a story–why is the story anything? Aren’t they supposed to look at precedents…know the details…or look them up. I would not be into a justice who did things just because they felt right or seemed more fair. That is something I would do! They should not.

    Equal and opposite forces often cause stalemate. I think we need much more female energy in the SC, but Barry-boy could’ve found someone less controversial and equally (if not moreso) qualified to nominate.

It also wouldn’t matter who Obama picked anymore than it mattered who Bush picked. The opposite side tries to tank the person. It’s what they have been doing back since Bork as far as I can remember.     I don’t care how attuned people are to adversity, how their individual experience pertains (most people have not encountered too much adversity or will have encountered diff kinds), or how they think about fair versus nonfair. The Supreme Court is supposed to juggle all the precedents and try to align them with what the founding fathers stated. To me, anyhow.

    I think there are things in Sotomayor’s judicial record that some people have honest disagreements with. I have issues with the firefighter decision and I’m entitled to my opinion not that anybody gives a shit what I think! But one issue does not a career make and I know that. There are issues that deserve to be aired and discussed though. But they won’t be it will just be all this stupid bullshit, and then she will be confirmed the votes are there. All of this is just noise….but why all the noise to drown out what???? Things that make you go hmmmm.

    We actually seriously looked into moving to Australia once, but didn’t. So serious we actually had all the immigration paperwork, DH was considering an offer from their government, but we couldn’t get a guarantee on our location. Trust me they have their own set of problems, for one they are woefully behind the US in the area of women’s rights. I could go on, the point is, a perfect place doesn’t exist.

    Sotomayor will be confirmed. But that doesn’t mean she shouldn’t be questioned. But I will have trouble with anyone Obama chooses, because of his prerequisite “empathy”. WTH is empathy to Barack Obama? Acorn has empathy, in his eyes.

Yes, it was “sexist” to suggest the judge might “feel” or “react” differently because of a biological factor. It was sexist to say Sarah Palin was a whore or bad mom bec she was a good-looking governor or whatever they said. I am not of the school, though, that bec she will be confirmed, we should not discuss it or cannot say what we think or are starting to think. She will probably do fine and we will forget about her in a month. I think, and I have said this, that her job is to hire a staff who can cover all the precedents and write well (they don’t do all this themselves, you know) and not interject her experiences as a woman, a Latina, a Mom, a wife, a grocery shopper, a scholarship earner, or anything else to any great degree.

    I don’t think background or past things is unused on any SCOTUS candidate. It’s the only way they can determine if the candidate meets their personal needs. congress I mean. We think big changes are coming here! I read a book (well, listened to) by Aravind Adiga, which I recommend. It’s called The White Tiger. It’s a first person account by an Indian villager (in the form of a letter to the Chinese premier who is soon to visit India) who becomes a driver for a rich man in Delhi. It’s his daily routine, his thoughts, his employer’s behavior and his dawning realization that he will be a servant to a master forever…unless…
    He announces pretty soon in the story what that “unless” involves, but you need to let him get to it. He ends up a rich man, owner of startup that services those Indian call centers we all love so much. Does he shrug off his “deed”? No–but he plunges on into history anyway. Food for thought. Should I say, curry for thought?

    I do think we are at a defining point in history. And that it will be dramatic. History does repeat itself. Obama might be right about this being a defining point after all……but he is such a megalomaniac, that he believes he doesn’t have to pay attention to history, he can do it his own way. Or he only sees the “great” part of the history of great men and women, without the work and struggle and sacrifices they made to be considered great.

    My kids are history buffs and are completely amazed by the lack of consideration of history (real history, not just what they have learned in their texts) by this president and administration.
